As part of legal action led by the Association alongside La Voix de l'Enfant, on 18 October the Court of Cassation overturned the Court of Appeal's ruling and confirmed that the Associations may request the courts to order Internet Service Providers (ISPs) directly to blocking access to a pornographic website.
«We have reached an important milestone in a legal process where the courts systematically refused to rule on the merits of the case. The judges will finally have to rule on the fate of pornographic websites that have refused to comply with the law for more than three years and which, in doing so, knowingly expose more and more children and adolescents to content that is traumatic for their emotional and sexual development. ” comments Justine Atlan, Chief Executive of the Association.
Reminder: in response to pornographic websites failing to comply with the July 2020 law requiring the implementation of a user age verification system, the e-Enfance/3018 Association took legal action alongside La Voix de l'Enfant to compel Internet Service Providers (ISPs) to block these sites. The judges refused to examine the associations' request, considering that they should have taken action against the publishers or hosts of the sites first.
