The National Assembly has just unanimously passed a bill proposed by MP Bruno Studer aimed at guaranteeing children's image rights.
Designed to better protect children on the Internet, this law seeks in particular to combat the abuse of certain parents – including influential parents – in the overexposure of their children on social media. An OPINIUM study has shown that a child under the age of 13 has an average of 1,300 photos of themselves on the internet. These may be on their own accounts, those of their parents or those of their relatives. It should be remembered that such exposure involves risks such as the misuse of photos for malicious purposes, cyberbullying, disclosure of confidential information, etc.
This vote therefore allows the concept of “privacy” in the definition of parental authority. The Civil Code will also be amended to allow family court judges to prohibit a parent from publishing or disseminating any image of their child without the consent of the other parent.
