Regulations for influencers?

It's official! Bruno Le Maire, Minister of the Economy, Finance and Industrial and Digital Sovereignty, announced measures on 24 March to regulate the profession of influencer in France.  Until now, there has been no legal framework with specific regulations for this profession.

Here is a recap of the main announcements:

  • Influencer activity will be included in the Consumer Code and the Commercial Code, it will therefore have to comply with clear rules.
  • Influencers will be required to follow the same rules than traditional advertising, for example the prohibition on promoting for cosmetic surgery, risky financial investments, or even a very strict supervision for the alcohol promotion or sports betting for example
  • For the influencers under the age of 16 : parents will need to obtain a administrative authorisation so that their child can be an influencer and 90% of the’The money earned will be frozen until they reach the age of majority.
  • The obligation to display the use of a filter or retouch on the contents photos and videos during a paid partnership.
